What Happens After You Win a Property Auction in South Africa?

Winning a property at auction is only the beginning. The real process starts the moment the hammer falls — and it moves fast. If you’re not clear on the next steps, you can expose yourself to unnecessary risk.
Immediately after the final bid is accepted, you are required to sign the Conditions of Sale. This document is legally binding and outlines every term of the transaction — purchase price, deposit, timelines, and obligations. There is no cooling-off period. Once signed, you are fully committed.
Next comes the deposit payment, typically around 10% of the purchase price, payable on the day of the auction or within a very short window. This is usually paid into the auctioneer’s trust account. In addition, you may be required to pay a buyer’s premium, depending on the auction terms.
After that, the focus shifts to settling the balance. This is generally required within 30 days, either via cash or bank guarantees if you’re using finance. This is where preparation becomes critical — delays at this stage can lead to penalties or even cancellation of the sale.
The conveyancing process then begins. The appointed transfer attorney (usually nominated by the seller or bank) handles the legal transfer of ownership. This includes:
Lodging documents at the Deeds Office
Ensuring rates clearance certificates are in place
Coordinating with the buyer’s bank if there’s a bond
During this period, you may also need to arrange insurance on the property, as risk often passes to the buyer before transfer is complete.
Once everything is processed and approved, the property is registered in your name at the Deeds Office. This is the official transfer of ownership. Only then do you take full legal possession, unless otherwise agreed.
If the property is occupied, you’ll need to manage the handover or eviction process, depending on the terms of sale.
